Case No.: MahaRERA/Secy/File No 27/215/2024
The Maharashtra Real Estate Regulatory Authority (MahaRERA) has recently issued an order that obligates builders to provide comprehensive information about the facilities and services that will be available in the property they are selling.
Key Aspects of the Order:
1. Comprehensive Listing of Amenities: Builders are now mandated to provide a detailed list of all amenities that will be available in the property. This includes features in the building itself, common areas, or the overall layout. Examples of such amenities include swimming pools, squash courts, badminton courts, tennis courts, table tennis courts, among others.
2. Size/Area and Availability Dates: The Sale agreement must clearly state the size or area of these amenities, along with the dates they will be accessible to the homebuyers, their families, and other residents.
3. Method of Disclosure: The MahaRERA order also provides guidelines on how these amenities should be disclosed in the agreement for sale. These guidelines can be found in “Annexure 1” attached to the order.
4. Non-negotiable Disclosure: The disclosure of amenities, as stated in “Annexure 1”, is non-negotiable. If this clause is not included in the sale agreements or is modified in any way, the builder may face action from MahaRERA.
The main goal of this order is to ensure that homebuyers are fully aware of what they are purchasing, thereby providing them with a greater sense of security and protecting their rights.
In conclusion, this order is a significant step towards transparency in real estate transactions. It ensures that buyers are well-informed about the amenities they can expect in their new homes, thereby preventing any potential disputes or disappointments in the future.
