Can a Complainant ask the Consumer Forum to deliver Interrogatories on a witness ( who is not a party to the case)….the answer is yes.
Hon’ble National Commission in case reported in 2011(3) CPR 162 (NC) titled Neeraj Amarnath Dora Versus Nandan Hospital & Ors. held that oral Cross examination of a witness or party under Consumer Protection Act 1986 is not a rule and it is only an exception.
It was held that State Commission as well as District Forums would follow practice of asking party to give interrogatories and thereafter reply of interrogatories on affidavits would be taken on record instead of permitting lengthy oral cross examination of witnesses.
