NCDRC: Insurance Premium Still Due If Cheque Is Not Cashed

The National Consumer Disputes Redressal Commission (NCDRC), led by Subhash Chandra and Sadhna Shanker, recently made a significant ruling against the National Insurance Company. In this case, the commission deemed that an insurance contract is not valid if an insurance premium cheque remains uncashed. This judgment implies that when an insured party’s cheque is not cashed due to their fault, it equates to the premium not being paid.

The case involved Vaibhavi Dredging Pvt. Ltd, a company that operates barges, tugs, and dredgers for dredging ports. When one of their barges, Vaibhavi Hopper-II, sank during a job for Western India Shipyard Ltd, the firm reported the incident to the Deputy Conservator of Marmagoa Port Trust the next day. However, their insurance claim was denied by the National Insurance Company, arguing that the insurance contract was not valid since the premium hadn’t been paid.

In response, Vaibhavi Dredging Pvt. Ltd contested this decision at the State Commission, arguing that the insurance contract was in effect during the incident, as they had deposited a quarterly premium installment of Rs. 55,000 by cheque. Despite this, the State Commission agreed with the insurer’s argument.

The insurer maintained that the State Commission’s decision was sound, based on the evidence and information available. They also argued that they had no obligation to compensate Vaibhavi Dredging as the insurance contract was not valid due to non-payment of the premium.

The NCDRC agreed with the insurer’s argument. The commission noted that the insurer hadn’t cashed the cheque for the insurance premiums at the time of the incident. They concluded that the insurance contract couldn’t be considered valid as the necessary documents hadn’t been submitted, and the required inspection condition survey hadn’t been undertaken.

In the end, the NCDRC found no merit in Vaibhavi Dredging’s appeal, upholding the State Commission’s decision. This case serves as a crucial reminder for insured parties to ensure that their premium payments are processed timely and properly to validate their insurance contracts. It also underscores the importance of fulfilling all requisite conditions and submitting necessary documentation to avoid any disputes.
